Consulting services for visa applications
This document constitutes a public offer by UWS OU, a company registered under Estonian law (hereinafter referred to as the“Contractor”), and is the person requesting the service to prepare a package of documents for obtaining a work visa (hereinafter referred to as the “Client”).
Payment for the service constitutes full and unconditional acceptance of the terms of this offer.
1. WHAT IS INCLUDED IN THE SERVICE
1.1. “Basic Service Package for Obtaining a D05 Work Visa”
As part of the service, the Contractor undertakes to provide the Client with:
1.1.1. basic consultation on matters related to obtaining a D05 work visa;
1.1.2. assistance in coordinating the invitation (Oświadczenie) with the employer;
1.1.3. preparation of a request for an invitation from the employer;
1.1.4. consulting support at all stages of service provision.
1.2. “Extended Service Package for Obtaining a D05 Work Visa”
As part of the service, the Contractor undertakes to provide the Client with:
1.2.1. basic consultation on matters related to obtaining a D05 work visa;
1.2.2. assistance in coordinating the invitation (Oświadczenie) with the employer;
1.2.3. preparation of a request for an invitation from the employer;
1.2.4. assistance in the process of preparing an insurance policy;
1.2.5. assistance in the process of completing the visa application form;
1.2.6. coordination of the process of scheduling an appointment at the visa center and submitting documents;
1.2.7. Consultative support at all stages of service provision.
1.3. “Basic Service Package for Obtaining a D06 Work Visa”
As part of the service, the Contractor undertakes to provide the Client with:
1.3.1. Basic consultation on matters related to obtaining a D06 work visa;
1.3.2. assistance in coordinating the work permit (Zezwolenie na pracę) with the employer;
1.3.3. preparation of a request for a Zezwolenie na pracę from the employer;
1.3.4. assistance in preparing a letter of guarantee (if required);
1.3.5. Consultative support at all stages of service provision.
1.4. General Terms and Conditions of Service Provision
1.4.1. The Contractor provides exclusively consulting and informational services and assistance in preparing documents.
1.4.2. The decision to issue a visa is made exclusively by the competent authorities of the relevant state.
1.4.3. The Contractor shall not be liable for the refusal to issue a visa, delays in the review of Documents, or decisions by third parties beyond the Contractor’s control.
1.4.4. The Client undertakes to provide, in a timely manner, accurate documents and information necessary for the provision of services.
2. PROCEDURE FOR PROVIDING THE SERVICE
2.1. To begin the service, the Client provides the Contractor with the information necessary to prepare a letter of recommendation by filling out a questionnaire or transmitting the information to the Contractor’s representative in electronic form (including via messaging apps or email).
2.2. The Client confirms that the information provided is accurate, up-to-date, and sufficient for preparing the document.
2.3. The Contractor begins providing the service after receiving the necessary data and confirmation of payment.
3. COST AND PAYMENT
3.1. The cost of the service is indicated on the payment page and in official communications with the Contractor’s representative.
3.2. The cost of the service is determined based on the scope and nature of the work performed, as well as the use of the company’s business reputation in preparing the document.
3.3. Payment for the service is made to the Contractor’s official payment details.
3.4. The contract is considered automatically concluded at the time of payment for the service.
4. REFUNDS
4.1. The service is considered rendered upon the transfer of documents to the Client in electronic form.
4.2. At the same time, the Contractor is interested in the Client’s successful employment and voluntarily offers a bonus condition:
– If the Client actually works for at least 30 calendar days with the agreed-upon employer, the Contractor will refund 100% of the service cost via the same payment method.
4.3. This refund does not constitute an admission of failure to provide the service and does not affect the fact of its proper performance.
5. PERSONAL DATA
5.1. As part of the candidate matching process, the Client’s personal data may be transferred to the employer.
5.2. The processing of personal data is carried out in accordance with European Union legislation (GDPR) and the Contractor’s Privacy Policy.
6. LIABILITY OF THE PARTIES
6.1. The Contractor is responsible for the proper preparation and execution of the services in accordance with the terms of this proposal.
6.2. The Contractor provides services as an independent HR partner and is not the Client’s employer, nor does it act as a party to the employment relationship between the Client and the employer.
6.3. Decisions made by the employer regarding the Client’s candidate, including hiring, changing the terms of the job opening, or refusing to hire, are beyond the Contractor’s control and cannot be considered an indicator of the quality of the service provided.
6.4. A request by the employer for additional documents cannot be considered an indication of improper service provision, as the employer’s requirements may change during the candidate selection process.
6.5. The Contractor has no influence over and bears no responsibility for decisions made by the employer following the review of the Client’s candidacy.
7. ELECTRONIC FORM AND EVIDENCE
7.1. This agreement is concluded in electronic form and does not require a signature.
7.2. The fact of payment for the service, the Client’s submission of source data, the preparation and submission of documents, as well as correspondence between the Parties in electronic form, shall constitute sufficient evidence of the proper provision of the service.
7.3. In the event of any discrepancies between the language versions of this offer, the English version shall prevail.
8. DISPUTE RESOLUTION
8.1. The Parties shall endeavor to resolve all disputes and disagreements through negotiation.
8.2. If a resolution cannot be reached, the dispute shall be resolved in accordance with the laws of Estonia at the Contractor’s place of registration.
